DimLicense-Protected (DL-P) v1.0

Preamble and Definitions

This DimLicense-Protected, hereinafter referred to as "DL-P", constitutes a restrictive legal instrument establishing stringent limitations upon the utilization, modification, and redistribution of specific computer software components, documentation segments, and designated code portions (collectively referred to as the "Protected Materials") created by and attributed to DimaDroid (the "Licensor").

DEFINITIONS: For purposes of this License, the following terminological clarifications shall apply with binding and unambiguous effect:

"Protected Code Section" shall mean the specific, designated, demarcated, and clearly identified portions of source code, object code, documentation, or other materials explicitly marked as subject to protection under this DL-P License, which portions are entirely and absolutely prohibited from modification, alteration, or removal.

"Verbatim Copy" shall mean an exact, unaltered, bit-for-bit identical reproduction of the Protected Materials without any modification, transformation, or change whatsoever to content, structure, formatting, or presentation.

"Tampering" shall mean any action, whether intentional or negligent, that results in modification, alteration, deletion, obfuscation, transformation, reconfiguration, or any other change to the Protected Code Section, regardless of the magnitude or perceived insignificance of such change.

"Circumvention" shall mean any attempt, whether successful or unsuccessful, to bypass, evade, nullify, or render ineffective the protections, restrictions, or requirements established by this License.

Scope of Protected Materials

The Protected Materials governed by this License consist of the following specifically designated code sections, which shall be clearly marked and delimited in the source code by the following boundary markers:

Any code, documentation, or materials appearing within these boundary markers, or otherwise explicitly designated as subject to DL-P protection, shall be considered Protected Materials subject to all restrictions enumerated herein.

Grant of Extremely Limited License

Subject to the stringent terms, conditions, prohibitions, and restrictions enumerated herein, the Licensor hereby grants to any person, entity, organization, or legal body obtaining a copy of the Protected Materials (the "Licensee") an extremely limited, conditional, non-exclusive, non-transferable, revocable license solely to:

1. Execute, run, and operate the Protected Materials in their unmodified, verbatim form as part of the larger software system in which they are incorporated.

2. Create Verbatim Copies of the Protected Materials solely for purposes of backup, archival, or Distribution as part of the complete, unmodified software package.

3. Study and examine the Protected Materials for educational or analytical purposes, provided no modification or derivative creation results therefrom.

Absolute Prohibitions and Restrictions

The following activities are absolutely, categorically, and irrevocably prohibited with respect to the Protected Materials, and any engagement in such activities constitutes immediate, material, and irreparable breach of this License:

1. MODIFICATION PROHIBITION: Under no circumstances whatsoever shall the Licensee modify, alter, change, transform, reconfigure, edit, amend, revise, adapt, translate, or otherwise make any change of any kind, magnitude, or nature to the Protected Code Section. This prohibition is absolute and admits of no exceptions, regardless of the purpose, intent, or claimed justification for such modification.

2. DELETION PROHIBITION: The Licensee shall not remove, delete, excise, extract, or eliminate the Protected Code Section from the software package, whether in whole or in part, regardless of whether such removal is replaced with alternative code or left vacant.

3. OBFUSCATION PROHIBITION: The Licensee shall not obfuscate, encrypt, encode, compress, or otherwise render less readable or accessible the Protected Code Section or the boundary markers delineating such section.

4. BOUNDARY MARKER PROHIBITION: The Licensee shall not remove, alter, modify, or relocate the boundary markers (BEGIN DIMLICENSE-PROTECTED and END DIMLICENSE-PROTECTED comments) that delineate and identify the Protected Code Section.

5. ATTRIBUTION REMOVAL PROHIBITION: The Licensee shall not remove, obscure, alter, or diminish the copyright notice, attribution to DimaDroid, or license identification appearing within or adjacent to the Protected Code Section.

6. DERIVATIVE WORK PROHIBITION: The Licensee shall not create derivative works based upon, derived from, or incorporating modifications to the Protected Code Section.

7. CIRCUMVENTION PROHIBITION: The Licensee shall not attempt to circumvent, bypass, nullify, or evade the protections and restrictions established by this License through technical means, legal interpretation, or any other methodology.

8. RELICENSING PROHIBITION: The Licensee shall not attempt to relicense, sublicense, or place the Protected Materials under any different license terms that would contradict, supersede, or diminish the restrictions enumerated herein.

Mandatory Preservation Requirements

Any Distribution of software containing Protected Materials must:

1. Preserve the Protected Code Section in its entirety, without any modification, alteration, or change.

2. Preserve all boundary markers, copyright notices, attribution statements, and license identifications associated with the Protected Code Section.

3. Include a conspicuous notice in the Distribution materials informing recipients that the software contains code protected under DimLicense-Protected (DL-P) v1.0 and that modification of such code is strictly prohibited.

4. Ensure that any compilation, linking, or integration of the Protected Materials with other software components does not result in modification or alteration of the Protected Code Section.

Verification and Integrity

Licensees distributing software containing Protected Materials are encouraged, though not required, to implement integrity verification mechanisms (such as checksums, hash functions, or digital signatures) to ensure the Protected Code Section remains unmodified. However, such verification mechanisms shall not themselves modify or alter the Protected Code Section.

Consequences of Violation

Any violation, breach, or non-compliance with the prohibitions and restrictions enumerated herein shall result in:

1. Immediate, automatic termination of all rights granted under this License, without notice or opportunity to cure.

2. Immediate obligation to cease all use, distribution, and possession of the Protected Materials.

3. Immediate obligation to destroy all copies of the Protected Materials in the Licensee's possession or control.

4. Potential liability for damages, injunctive relief, and any other remedies available at law or in equity.

5. Potential liability for copyright infringement, breach of contract, and violation of intellectual property rights.

Warranty Disclaimer

THE PROTECTED MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY, REPRESENTATION, COVENANT, OR GUARANTEE OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, ACCURACY, RELIABILITY, CORRECTNESS, AND SYSTEM INTEGRATION. THE LICENSOR MAKES NO WARRANTY THAT THE PROTECTED MATERIALS WILL MEET LICENSEE'S REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, ACHIEVE ANY INTENDED RESULT, BE COMPATIBLE WITH ANY OTHER SOFTWARE OR SYSTEM, OR BE SECURE, ACCURATE, COMPLETE, FREE OF HARMFUL CODE, ERROR-FREE, OR FIT FOR ANY PARTICULAR PURPOSE WHATSOEVER.

Limitation of Liability

IN NO EVENT SHALL DIMADROID, THE LICENSOR, OR ANY CONTRIBUTORS TO THE PROTECTED MATERIALS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, AGGRAVATED, OR OTHER DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOSS OF USE, DATA, OR PROFITS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, LOSS OF STORED DATA, CORRUPTION OF FILES, SYSTEM CRASHES, SECURITY BREACHES, LEGAL FEES, LITIGATION COSTS, REPUTATIONAL HARM, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, TORT (INCLUDING NEGLIGENCE OR OTHERWISE), STATUTORY LIABILITY, OR ANY OTHER THEORY, ARISING IN ANY WAY OUT OF THE USE, ATTEMPTED USE, MODIFICATION, DISTRIBUTION, OR INABILITY TO USE THE PROTECTED MATERIALS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND REGARDLESS OF WHETHER SUCH DAMAGE WAS FORESEEABLE.

Indemnification

The Licensee agrees to indemnify, defend, and hold harmless DimaDroid, the Licensor, and all contributors to the Protected Materials from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to the Licensee's use, modification, distribution, or other handling of the Protected Materials, or any breach or alleged breach of this License.

Severability and Interpretation

If any provision of this License is held by a court of competent jurisdiction to be unenforceable, invalid, or contrary to law, that provision shall be enforced to the maximum extent permissible under applicable law, and the remaining provisions shall remain in full force and effect. The section headings used herein are for convenience only and shall not affect the interpretation of this License. Any ambiguity in the terms of this License shall be construed in favor of the Licensor and the preservation of the restrictions enumerated herein.

Governing Law and Jurisdiction

This License shall be governed by and construed in accordance with applicable law without regard to its conflict of law provisions. Any dispute arising out of or relating to this License shall be subject to the exclusive jurisdiction of the courts having jurisdiction over the Licensor's principal place of business.

Entire Agreement and Amendments

This License constitutes the entire agreement between the Licensor and Licensee concerning the subject matter hereof and supersedes all prior or contemporaneous oral or written agreements, understandings, representations, or communications concerning such subject matter. This License may not be modified, amended, supplemented, or waived except by written instrument executed by the Licensor.
